1. ABOUT US AND CONTACT DETAILS
1.1. Company Information: This website ([https://www.visionsenlight.com](https://www.visionsenlight.com), referred to as the “Website” or “Services”) is owned and operated by Visions Enlight Ltd (“Company”, “we”, “us”, or “our”), a company registered in England and Wales under company number 17170058, with our registered office at 28 Conway Rd, Cannington, Bridgwater, Somerset, TA5 2NP, United Kingdom.
1.2. Data Protection Registration: We are registered with the UK Information Commissioner’s Office (ICO) for data protection compliance.
1.3. Contact Information: You can contact us regarding bookings, orders, gallery access, or complaints by email at enquiries@visionsenlight.com, by phone at +447506968603, or by post at 28 Conway Rd, Cannington, Bridgwater, Somerset, TA5 2NP, United Kingdom.
2. AGREEMENT TO TERMS & TARGET AUDIENCE (B2C AND B2B)
2.1. Binding Agreement: These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you” or “Client”), and Visions Enlight Ltd, concerning your access to and use of the Website and Services. By accessing the Website, booking a session, or purchasing products, you confirm that you have read, understood, and agreed to be bound by all of these Terms.
2.2. Open Target Audience (Consumers and Business Clients): These Terms apply to both Consumers (individuals acting wholly or mainly outside their trade, business, craft, or profession, such as private vehicle owners booking bespoke automotive photography) and Business Clients / Non-Consumers (commercial entities, sole traders, or organisations booking commercial photography, thermal imaging, event coverage, or aerial drone surveying). Where specific statutory rights apply exclusively to Consumers under UK or EU law, this is explicitly stated.
2.3. Age Requirement (18+): Our Website and Services are intended solely for users who are at least 18 years old. Persons under the age of 18 are not permitted to use, register for, or place orders through the Website. By placing an order or entering a Unique Gallery Access Code, you warrant that you have the legal capacity to enter into a binding contract.
2.4. Independent Contractor Status: Nothing in these Terms creates any relationship of employment, agency, joint venture, or partnership between Visions Enlight Ltd and any Client.
3. INTELLECTUAL PROPERTY, COPYRIGHT & USAGE RIGHTS (“ALL RIGHTS RESERVED”)
3.1. Ownership of Website Content & Marks: Unless otherwise indicated, we are the owner or licensee of all intellectual property rights in our Website and Services, including all source code, databases, website designs, text, photographs, mid-air light painting imagery, custom bitmap graphics, thermal data, aerial video, and brand logos (collectively, the “Content” and “Marks”), protected under the UK Copyright, Designs and Patents Act 1988 and international treaties (“All Rights Reserved”).
3.2. Bespoke Automotive Photography & Private Commissions (B2C Licence): Visions Enlight Ltd retains overarching copyright to all photographs and digital media captured during any Bespoke Photography For Your Car or private light painting session. Upon full payment, the Consumer is granted a non-exclusive, non-transferable, perpetual personal licence to download, print, and display the purchased images for personal, non-commercial use (including sharing on personal social media profiles, provided Visions Enlight Ltd is credited). You may not resell, sub-license, submit for commercial gain, or use the images to advertise any business, product, or service without a separate written commercial licence from us.
3.3. Standard Event Media & Commercial Content (B2B Licence): Visions Enlight Ltd retains overarching copyright to all standard photographic, thermal, and video media captured. Upon final payment, the Business Client is granted a non-exclusive, perpetual licence to use, reproduce, and distribute the agreed digital marketing content and event media for internal business and standard promotional purposes as specified on the invoice. The Client may not sell raw or edited media to third-party stock agencies without prior written consent.
3.4. Specialized Imaging (Kirlian Photography): Due to the specialized technical nature of Kirlian aura photography, Visions Enlight Ltd retains full intellectual property rights to the resulting electro-photographic images. Clients are granted a personal use licence for these unique images; commercial reproduction, mass distribution, or significant digital alteration of Kirlian imagery requires a separate commercial licensing agreement.
3.5. Portfolio & Promotional Rights: Visions Enlight Ltd reserves the right to display select photographs and media captured during your session (excluding sensitive or confidential business data) for promotional purposes, including portfolio display on visionsenlight.com, social media channels, exhibitions, and marketing materials, unless a strict Non-Disclosure Agreement (NDA) or confidentiality opt-out has been agreed in writing prior to the shoot. For private automotive shoots, we will obscure vehicle registration plates upon prior request.
4. ACCEPTABLE USE & ANTI-SCRAPING RESTRICTIONS
4.1. Lawful Use Only: You may not access or use the Website for any purpose other than that for which we make it available.
4.2. Anti-Scraping & AI Harvesting Prohibition: You are strictly prohibited from using, launching, or distributing any automated system—including any spider, robot, scraper, screen-grabber, offline reader, or data-mining tool—to systematically retrieve, extract, harvest, or index any photographs, galleries, text, or data from our Website, including for the purpose of training artificial intelligence (AI) or machine learning models.
4.3. Security & Gallery Protection: You must not circumvent, disable, screen-capture, or otherwise interfere with security-related features of the Website, including watermark overlays, right-click restrictions, or password/code protections enforcing limitations on the use or copying of private client galleries.
4.4. Excessive Use & System Integrity: You must not upload viruses or malicious code, or subject our Website, servers, or high-resolution image galleries to excessive bandwidth loads or automated requests.
4.5. Commercial Misuse: Products and services on the Website are provided for legitimate purchase only. You must not use the Website to compete with us, or resell or redistribute our content, products, or gallery access credentials.
5. PRIVATE CLIENT GALLERIES, UNIQUE ACCESS CODES & REGISTRATION
5.1. Optional Account Registration & Unique Access Codes: General browsing of the Website does not require registration. When you book and pay upfront for an imaging session (such as a bespoke car light painting shoot), you will receive a Unique Identifier / Gallery Access Code (and/or customer account login) to access your private images on visionsenlight.com and order downloads or Print on Demand products.
5.2. Confidentiality & Non-Sharing: You must maintain only one account per user, keep your Unique Identifier Code and password strictly confidential, and not share your access code publicly or with unauthorized third parties. You are responsible for all activity conducted using your access code.
5.3. Account Suspension & Termination: You may terminate your account or gallery access at any time via the Website interface or by emailing us at enquiries@visionsenlight.com. We reserve the unconditional right, in our sole discretion and without prior notice, to suspend, revoke, or delete any account or Unique Access Code if we suspect unauthorized sharing, scraping, or breach of these Terms.
5.4. Gallery Archiving & Client Backups: Private client galleries remain accessible online for 60 days from the date your Unique Access Code is issued unless stated otherwise in writing. Once you download your digital images, you are solely responsible for backing up and safeguarding your files.
6. BOOKING PROCESS, NON-BINDING OFFERS & PAYMENTS
6.1. Non-Binding Offer & Acceptance: All service descriptions and prices on the Website constitute an invitation to treat. Submitting an order or booking request constitutes a non-binding offer to purchase. A binding contract is concluded only when we explicitly accept your booking/order in writing (after verifying date availability, location safety, or airspace clearance) and confirm receipt of payment. We reserve the right to refuse or cancel any order in our sole discretion.
6.2. Currency & Payment Methods: All prices and payments are in GBP (£). We accept payment via our integrated third-party checkout providers (including Visa, Mastercard, and digital wallets via SureCart) as well as direct UK Bank Transfer (BACS) where agreed on invoices.
6.3. Upfront Payment, Deposits & Instalments: For bespoke car photography and light painting sessions, upfront payment (or an agreed booking deposit followed by instalment payment prior to gallery release) is required. Your Unique Identifier Code to access and download your images will be issued only after all session fees have cleared in full.
6.4. Promotional Offers & Discounts: We may occasionally offer promotional discounts or voucher codes on the Website, which are subject to the specific conditions and expiry dates stated at the time of issue.
7. BESPOKE AUTOMOTIVE PHOTOGRAPHY & EVENT COVERAGE
7.1. Weather Dependency (Car Light Painting & Outdoor Shoots): Bespoke mid-air light painting, night photography, and outdoor vehicle shoots require dry, low-wind conditions. If we deem weather conditions unsuitable or unsafe for equipment, we reserve the right to postpone and reschedule the session to the next mutually convenient date at no penalty or extra charge to the Client.
7.2. Vehicle Readiness, Safety & Positioning: The Client is solely responsible for ensuring that the subject vehicle is clean, insured, road-legal (unless located on private property with landowner permission), and safely positioned. Visions Enlight Ltd personnel will never drive or operate a Client’s vehicle; all vehicle movements during the shoot must be carried out by the Client.
7.3. Event Coverage & Cancellations: A confirmed booking secures the agreed date and time. Cancellations made by the Client within 48 hours of a scheduled event or shoot (other than weather postponements agreed by us) may be subject to a cancellation or rescheduling fee of up to 50% of the booking fee to cover reserved schedule time and travel preparation.
7.4. Digital Asset Turnaround: Standard turnaround time for processing and uploading edited digital assets (including bespoke car photography, drone surveys, and event media) is 14 business days following the session, unless otherwise specified in writing.
8. AERIAL OPERATIONS AND COMMERCIAL DRONE SURVEYING
8.1. UK CAA Regulatory Compliance: All aerial drone operations are conducted strictly in accordance with UK Civil Aviation Authority (CAA) regulations. The remote pilot in command retains absolute authority over every flight and may delay, refuse to commence, or terminate operations immediately if conditions become unsafe or risk breaching CAA guidelines.
8.2. Weather Dependency: Drone surveying and aerial imaging are entirely weather-dependent. In the event of high winds, precipitation, poor visibility, or geomagnetic interference, Visions Enlight Ltd reserves the right to postpone and reschedule the flight without penalty.
8.3. Airspace & Site Access Permissions: The Client is responsible for ensuring authorized access and landowner permission for the take-off, landing, and subject property. If the operation falls within restricted airspace requiring special Non-Standard Flight (NSF) or Air Traffic Control permissions, additional administrative lead time and fees may apply. We are not liable for delays caused by airspace denial by aviation authorities.
9. DIGITAL DOWNLOADS & PRINT ON DEMAND (POD) FULFILMENT
9.1. Technical Requirements for Digital Goods: Digital photographs and reports are supplied in standard formats (such as JPEG, PNG, TIFF, or PDF). To access your private gallery and download digital goods, you require a commonly used, up-to-date device and browser with a stable internet connection.
9.2. Print on Demand (PoD) Products & Colour Accuracy: When accessing your private gallery on visionsenlight.com via your Unique Access Code, you may order bespoke physical prints, framed wall art, or merchandise fulfilled via our third-party Print on Demand service partners. We calibrate our digital master files to high standards, but because consumer mobile and computer monitors vary in brightness and colour calibration, we cannot guarantee that your screen display will identically match the physical print tint.
9.3. Delivery of Physical Goods: Physical Print on Demand orders are manufactured to order and dispatched to the shipping address provided at checkout. Risk in physical goods passes to you upon delivery.
10. STATUTORY CANCELLATION RIGHTS & LEGAL EXCEPTIONS (UK & EU CONSUMERS)
10.1. Standard 14-Day Right to Cancel / Withdraw (Where Applicable): If you are a Consumer resident in the United Kingdom or the European Union, under the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (and EU Directive 2011/83/EU), you normally have 14 days to cancel a distance contract for standard, non-personalized physical goods or uncommenced services without giving any reason. Where standard non-personalized physical goods are returned under this right, the direct cost of returning the goods is borne by you.
10.2. MANDATORY EXCEPTIONS — WHEN THE RIGHT TO CANCEL / WITHDRAW DOES NOT APPLY: Pursuant to Regulation 28 and Regulation 37 of the UK Consumer Contracts Regulations 2013 (and Article 16 of the EU Directive), you do NOT have a 14-day right to cancel, withdraw, or request a change-of-mind refund for:
- (a) Bespoke & Clearly Personalized Goods (Print on Demand Orders): The supply of goods made to the consumer’s specifications or clearly personalized—including all Print on Demand photographic prints, wall art, canvases, and merchandise printed with bespoke images of your vehicle or private commission. All sales of custom Print on Demand items are final once production begins.
- (b) Digital Content Downloads: The supply of digital content not supplied on a tangible medium (such as downloadable high-resolution photographs), once performance/downloading has begun with your prior express consent and your acknowledgement that you thereby lose your right to cancel.
- (c) Fully Performed Services: The provision of photography, light painting, thermal, or drone imaging services after the service has been fully performed, where performance began with your prior express request and acknowledgement that you lose your cancellation right once the shoot is completed.
10.3. Statutory Guarantees of Conformity (Faulty or Damaged Goods): Nothing in these Terms affects your mandatory statutory rights as a UK or EU Consumer under the UK Consumer Rights Act 2015 requiring that goods, digital content, and services conform to the contract, be of satisfactory quality, and be fit for purpose. If a physical Print on Demand item arrives damaged in transit or with a verifiable manufacturing defect, please email enquiries@visionsenlight.com with photographs of the damage within 7 days of receipt so we can issue a replacement or refund.
11. DISCLAIMERS, LIMITATIONS OF LIABILITY & INDEMNITY
11.1. Liability That Cannot Be Excluded: Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any statutory consumer rights that cannot be excluded under UK law.
11.2. Force Majeure & Specific Operational Limitations: Visions Enlight Ltd shall not be liable for any failure, delay, or missed moments caused by events beyond our reasonable control, including sudden adverse weather, airspace lockdowns, interference from event guests, restricted venue access, third-party print/courier delays, power outages, or unavoidable equipment malfunction despite routine maintenance.
11.3. Exclusion of Indirect & Business Losses: Subject to Clause 11.1, in no event shall Visions Enlight Ltd or our directors be liable for any indirect, consequential, incidental, or special damages, or for any loss of profits, loss of revenue, loss of business opportunity, goodwill, or data arising from your use of the Website or Services.
11.4. Maximum Liability Cap (Including B2B Compensation Cap): Subject to Clause 11.1, our total aggregate liability to you for any claim arising out of or in connection with these Terms or any service/order (whether in contract, tort, negligence, or otherwise) shall be strictly limited to 100% of the total amount actually paid by you to Visions Enlight Ltd for the specific service or product giving rise to the claim during the twelve (12) month period immediately preceding the cause of action.
11.5. Indemnification (Including B2B Digital & Site Indemnity): You agree to defend, indemnify, and hold Visions Enlight Ltd harmless against any third-party claims, losses, liabilities, or legal expenses arising out of: (a) your breach of these Terms; (b) your unauthorized commercial use or alteration of our digital products or Kirlian/photographic media; or (c) your failure to obtain required landowner, venue, or vehicle permissions for an on-location shoot or drone flight.
12. PRIVACY POLICY & ELECTRONIC COMMUNICATIONS
12.1. Privacy Policy Incorporation: We care deeply about data privacy and security, including when capturing your email address for order completion, issuing Unique Gallery Access Codes, and fulfilling Print on Demand orders. Please review our Privacy Policy at https://www.iubenda.com/privacy-policy/59811370 (and on our Website Privacy Policy page), which is incorporated into these Terms.
12.2. Electronic Communications & Signatures: Visiting the Website, sending us emails, entering Unique Access Codes, and completing online checkout forms constitute electronic communications. You consent to receive electronic communications and invoices, and agree that electronic orders and acceptances satisfy all legal requirements that communications be in writing.
13. COMPLAINTS & DISPUTE RESOLUTION
13.1. Amicable Dispute Resolution (14-Day Reply Commitment): If you experience any issue or have a complaint regarding our Website, photography services, digital downloads, or Print on Demand orders, please email us your complaint at enquiries@visionsenlight.com and we will try to help. We commit to investigating your query fairly and replying to you within 14 days of receipt.
14. GOVERNING LAW, JURISDICTION & GENERAL PROVISIONS
14.1. Governing Law: These Terms and any dispute or claim arising out of or in connection with them are governed by and construed in accordance with the laws of England and Wales (United Kingdom), without regard to conflict-of-law principles. If you are a Consumer habitually resident in Scotland, Northern Ireland, the EU, or Switzerland, you additionally retain the protection of any mandatory statutory consumer provisions of your country of residence.
14.2. Venue of Jurisdiction: Competence to decide any controversy arising from these Terms lies exclusively with the courts of England and Wales (where Visions Enlight Ltd is established), save that this exclusive jurisdiction restriction does not apply to Consumers resident in the UK, EU, Switzerland, Norway, or Iceland, who may bring proceedings either in the courts of England and Wales or in the courts of the country in which they reside.
14.3. Severability: If any provision or part-provision of these Terms is determined by a court of competent jurisdiction to be unlawful, void, or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it enforceable (or severed if modification is impossible), and shall not affect the validity and enforceability of the remaining provisions.
14.4. Changes to These Terms: We reserve the right to update or modify these Terms from time to time. We will notify users of the effective date of any changes by updating the “Last Updated” date at the top of this document. Modifications will not apply retroactively to orders already accepted.
14.5. Entire Agreement & No Waiver: These Terms (together with our Privacy Policy and any specific written booking confirmation or NDA signed with you) constitute the entire agreement between you and Visions Enlight Ltd. Our failure to exercise or enforce any right or provision of these Terms shall not operate as a waiver of such right or provision.
